Terms of Service

Welcome to PostKit AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and PostKit AI ("we", "us", or "our") governing your use of the PostKit AI mobile application ("App") and related services ("Services").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

This agreement also serves as the End-User License Agreement (EULA) for the App distributed through the Apple App Store. This EULA is between you and PostKit AI only, and not with Apple Inc. ("Apple"). For reference, Apple's standard EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula.

1. Acknowledgement

You acknowledge that this EULA is concluded between you and PostKit AI only, and not with Apple. PostKit AI, not Apple, is solely responsible for the App and its content. This EULA may not provide for usage rules that are less restrictive than or otherwise in conflict with the Apple Media Services Terms and Conditions as of the date you agreed to these Terms.

2. Scope of License

PostKit AI grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

You may not:

• Distribute, sublicense, or otherwise make the App available to third parties
• Reverse-engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Remove any proprietary notices or labels on the App

3. Subscriptions and In-App Purchases

PostKit AI may offer auto-renewable subscriptions and in-app purchases. By purchasing a subscription, you agree to the following:

• Subscription fees are charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan
• You can manage and cancel your subscriptions in your Apple ID Account Settings after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Subscription prices are subject to change. Price changes will be communicated to you in advance through the App or via email. Payments are processed by Apple. For payment-related issues, please refer to Apple Support.

4. User Content and Acceptable Use

You are solely responsible for any content you create, generate, or share using the App. You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on any third party's intellectual property, privacy, or other rights
• Distribute spam, malware, or any harmful content
• Violate any applicable laws, regulations, or the terms of service of connected social media platforms
• Impersonate any person or entity

AI-generated content is provided as-is. You are responsible for reviewing and ensuring the accuracy and appropriateness of all content before publishing on any platform.

5. Maintenance and Support

PostKit AI is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

6. Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PostKit AI does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. PostKit AI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be PostKit AI's sole responsibility.

7. Product Claims

You acknowledge that PostKit AI, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to:

• Product liability claims
• Any claim that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of HealthKit and HomeKit frameworks, if applicable

8. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to all copyrights, trademarks, trade secrets, patents, and other intellectual property rights, are and shall remain the exclusive property of PostKit AI.

You acknowledge that PostKit AI, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the App.

9. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties
• You will comply with all applicable local, state, national, and international laws and regulations in your use of the App

10. Third-Party Services

The App may integrate with or link to third-party services, including but not limited to social media platforms (Instagram, X, LinkedIn, Facebook, WhatsApp, TikTok) and AI service providers. Your use of such third-party services is subject to their respective terms of service and privacy policies. You agree to comply with all applicable third-party terms of agreement when using the App.

PostKit AI is not responsible for the availability, accuracy, or content of third-party services, nor for any damage or loss caused by your use of or reliance on such services.

11. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTKIT AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF POSTKIT AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PostKit AI's total aggregate liability to you for any and all claims arising from or related to the App shall not exceed the total amount you have paid to PostKit AI for the App in the twelve (12) months immediately preceding the event giving rise to the claim.

13. Termination

These Terms are effective until terminated by you or PostKit AI. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of the terms. Upon termination, you shall cease all use of the App and delete all copies from your devices.

PostKit AI reserves the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
